This privacy policy applies to our eCRATER websites (also referred as "Website" in this document) and describes how eCRATER collects and handles your personal information when you use our Website.
We don’t track you or sell your information. That’s our Privacy Policy in a nutshell.
- 1. Information we collect and store
If you are a merchant, when you register we collect and store your username, full name, address, city, state/province, zip/postal code, country, phone, fax, email and IP address. Only your username, city and state will be publicly displayed. If you prefer your product pages to not show your city, you can hide your city by enabling "Hide your city in the product page" in menu Options. The rest of the information we collect from the merchants is not publicly available and is available to eCRATER only. It is part of the contractual agreement between eCRATER and you as a merchant to use the Website.
If you are a buyer, we collect and store your name, address, phone (if provided), email and IP address. This information is not publicly available and is available only to the merchant you ordered from with the sole purpose of shipping your order and/or contacting you in regards to your order.
- 2. Disclosure of your information
We do not release your personal information to third parties. However, eCRATER may disclose the User's identity and contact information, if we suspect that the seller created fraudulent store, or if requested by a government or law enforcement body, an injured customer, or as a result of a subpoena or other legal action, and eCRATER shall not be liable for damages or results thereof and User agrees not to bring any action or claim against eCRATER for such disclosure.
- 3. Merchant's responsibilities
If you sell on this Website, this means you process personal information (for example, buyer name, email address, phone and shipping address and IP address) and, to the extent you do so, under EU law, you are an independent controller of data relating to other users that you have obtained through the Website. You are responsible for protecting your buyer's personal information you receive and complying with all relevant legal requirements when you use the Website. Also, if you disclose personal information without the buyer's proper consent, you are responsible for that unauthorized disclosure.
For example, you may receive a buyer's email address or other information as a result of entering into a transaction with that buyer. This information may only be used for eCRATER related communications or for eCRATER facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer's consent, you may not add any eCRATER buyer to your email or physical mailing list, use that buyer's identity for marketing, or obtain or retain any payment information.
- 4. Retention of information
eCRATER will retain your information as long as your account is not deleted. If you no longer want eCRATER to use your personal information, you may close your account and contact us at through our contact link located at the bottom of every page. eCRATER will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. In addition, eCRATER sellers may also be required to retain and use your information in order to comply with their legal obligations. Please note that closing your account will not free up your email address and username for reuse on a new account.
- 5. Cookies
We don’t track you. We use cookies to allow users to add products in the shopping cart and place their orders, to allow merchants to login, and for captcha confirmation.
- 6. Google services
We partner with Google to display advertising on our Website. Google uses cookies to collect non-personally identifiable information about your activities on the Website. You can adjust your Google ad settings at here. We also use Google Analytics to measure the traffic on our Website. Accordingly, your browser will send to Google the URL of the page you are visiting and your IP address.
- 7. Third party sites
The Website contains links to other Websites. If you access a linked site, you may be disclosing your IP address to them. eCRATER is not responsible for the personal information you may disclose by accessing other sites through links on our Website.
- 8. EU data rights
You have the right to access, rectify, delete or restrict of processing any of your personal data. Our merchant interface provides you with tool to view/change/delete your personal information (menu Account Info). You may also contact us through the contact link located the bottom of every page and request access to, deletion or object processing of your personal data. Please note that you will be required to submit additional information to prove that you are EU citizen.
We are located in the United States and we transfer your personal data for processing and storing in United States. We are commited to fully comply with the Data Privacy Framework Principles.
- 9. Facebook app
If you connect your store with Facebook, eCRATER will only store information that is already public on Facebook: your FB account id and name and in cases when your account is connected to a FB page: your FB page id and name. This information is needed so you can share product information on a specific FB account or page. If you no longer wish to use our app, please use the delete icon in menu Social to unlink your store from Facebook. If you would like to delete a post history, please click on the delete icon in the "Post To Facebook" page. Alternatively, you may ask us to delete or remove your Personal Data.
